1. ACCEPTANCE OF TERMS

FlashcardDB (the "Internet Flashcard Database") (the "Site"), provides the information and services on the Site to you, the user, conditioned upon your acceptance, without modification, of the terms and conditions of use applicable to the Site. Your use of the Site constitutes agreement with the terms and conditions of use set forth herein (the "Terms").

2. CHANGES AND MODIFICATIONS TO THE TERMS

FlashcardDB reserves the right, at FlashcardDB's sole discretion, to change, modify, add or remove portions of these Terms periodically. Such modifications shall be effective immediately upon posting of the modified agreement to the website unless provided otherwise. Your continued use of the FlashcardDB Site following the posting of changes to these Terms will mean that you accept those changes. Any new features or tools which are added to the current Site shall also be subject to these Terms.

3. DISCONTINUATION OF SERVICE

FlashcardDB reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently the FlashcardDB website (or any part thereof). FlashcardDB shall not be liable to any user or other third party for any such modification, suspension or discontinuance.

4. USER-POSTED CONTENT

By posting content on the Site, you are granting permission to us and others to access and use it in connection with the services provided by the Site and otherwise in connection with our business. You can mark content as private to restrict access and use to those users to whom you explicitly grant access. FlashcardDB may, but has no obligation to, remove Content and Accounts containing Content that is determined at FlashcardDB's sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.

5. NO WARRANTY AND LIMITATION OF LIABILITY

FLASHCARDDB PROVIDES THE SITE AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. FLASHCARDDB SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, INFORMATION ACCURACY, INTEGRATION, INTEROPERABILITY OR QUIET ENJOYMENT. You understand and agree that your use of the Site is at your own discretion and risk and that you will be solely responsible for any damages that arise from such use. UNDER NO CIRCUMSTANCES SHALL FLASHCARDDB BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY KIND, OR ANY OTHER DAMAGES WHATSOEVER (HOWEVER ARISING, INCLUDING BY NEGLIGENCE), INCLUDING WITHOUT LIMITATION, DAMAGES RELATED TO USE, MISUSE, RELIANCE ON, INABILITY TO USE AND INTERRUPTION, SUSPENSION, OR TERMINATION OF THE SITE OR SERVICES, DAMAGES INCURRED THROUGH ANY LINKS PROVIDED ON THE SITE AND THE NONPERFORMANCE THEREOF AND DAMAGES RESULTING FROM LOSS OF USE, SALES, DATA, GOODWILL OR PROFITS, WHETHER OR NOT FLASHCARDDB HAS BEEN ADVISED OF SUCH POSSIBILITY. YOUR ONLY RIGHT WITH RESPECT TO ANY DISSATISFACTION WITH THIS SITE OR WITH FLASHCARDDB OR WITH THE INTERNET FLASHCARD DATABASE SHALL BE TO TERMINATE USE OF THIS SITE.
